1. Introduction & Agreement to Terms

Welcome to SauceSavvy ("SauceSavvy," "we," "us," "our"). We provide artisanal food products, specifically sauces, and related services through our e-commerce website (the "Service"). These Terms of Service ("Terms") constitute a legally binding agreement between you (the "Customer," "user," "you," or "your") and SauceSavvy. These Terms govern your access to and use of our website, www.saucesavvy.com (the "Platform"), and all related services, including the browsing of products, creation of an account, purchasing of goods, and interaction with our content. By creating an account, placing an order, or otherwise using our Platform, you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you may not use our Platform or purchase our products.

2. Eligibility

To create an account or place an order with SauceSavvy, you must be at least eighteen (18) years of age and possess the legal authority to enter into a binding contract. By using our Platform, you represent and warrant that you meet these eligibility requirements. You affirm that all information you provide to us during the registration and checkout process, including your name, shipping address, and payment information, is true, accurate, current, and complete. Providing false or inaccurate information may result in the cancellation of your order and termination of your account.

3. Orders, Payment & Confirmation

Ordering Process: Orders for our products can be placed exclusively through our Platform. An order is considered a formal offer to purchase the products listed in your cart. We reserve the right to accept or reject any order at our sole discretion for reasons including, but not limited to, product unavailability, errors in pricing or product descriptions, or suspicion of fraudulent activity.

Payment: Full payment is required at the time of placing an order. We accept major credit cards and other payment methods as indicated at checkout. All payments are processed through secure, third-party PCI-compliant payment gateways. We do not store your full credit card information on our servers. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Platform.

Confirmation and Pricing: After you place an order, you will receive an email from us acknowledging that we have received your order ("Order Confirmation"). This email does not constitute acceptance of your order. A legally binding contract is formed only when we send you a subsequent email confirming that your order has been shipped ("Shipping Confirmation"). All prices are listed in USD and are subject to change without notice. Prices do not include applicable taxes or shipping fees, which will be added to your total at checkout.

4. Our Products & Service Availability

SauceSavvy provides high-quality, artisanal sauces. We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Platform. However, we do not guarantee that they will be accurate, complete, reliable, current, or free of other errors. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. From time to time, due to the artisanal nature of our production and reliance on seasonal ingredients, product formulations or packaging may change slightly.

5. Customer Responsibility, Allergens & Product Use

Accurate Information: You are responsible for providing a complete and accurate shipping address. SauceSavvy is not liable for orders that are lost, delayed, or returned due to an incorrect or incomplete address provided by you. Any additional shipping costs incurred to resend such an order will be your responsibility.

Allergen Information: We provide detailed ingredient lists on each product page and on the physical product label. It is your sole responsibility to review this information to ensure it is safe for your consumption, especially if you have food allergies or sensitivities. Our products are manufactured in a facility that may also process common allergens including, but not limited to, nuts, soy, gluten, and dairy. While we adhere to strict food safety protocols, we cannot guarantee against the possibility of cross-contamination.

Assumption of Risk: By purchasing our products, you acknowledge that some products, particularly our hot sauces, are intended for consumption by adults and should be kept out of reach of children. You agree to use these products responsibly and at your own risk. SauceSavvy is not liable for any discomfort, injury, or adverse reaction resulting from the consumption or misuse of our products.

6. Account Management & Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. SauceSavvy will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge.

7. User Conduct & Content

You agree not to use the Platform for any unlawful purpose or to solicit others to perform or participate in any unlawful acts. You are prohibited from posting any content (such as in product reviews) that is obscene, defamatory, threatening, infringing on intellectual property rights, or otherwise injurious to third parties. We reserve the right to remove such content and to terminate the accounts of users who violate these provisions, without refund or notice.

8. Return & Refund Policy

Our policy is designed to ensure customer satisfaction while adhering to food safety standards.

• Damaged or Incorrect Items: If you receive an item that is damaged, defective, or incorrect, please contact our Customer Care team within 7 days of delivery. You must provide your order number and a photo of the issue. We will gladly send a replacement or issue a full refund for the affected item(s) at our discretion.
• Satisfaction: Your enjoyment of our products is important to us. If you are unsatisfied with a product for any reason, please contact our Customer Care team. While we typically cannot accept returns of opened food products due to safety and hygiene reasons, we will work with you on a case-by-case basis to find a satisfactory solution, which may include store credit or a partial refund.
• Unopened Items: We do not accept returns of unopened items due to the perishable nature of our products and to ensure quality control. All sales are considered final except in the case of damage or error as outlined above.

9. Intellectual Property

The "SauceSavvy" name, our logo, website design, text, graphics, photographs, product names, recipes, and all other content associated with the Service are the exclusive intellectual property of SauceSavvy and are protected by international copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive license to access our Platform for your personal, non-commercial use. Any unauthorized use, reproduction, or distribution of our content is strictly prohibited.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAUCESAVVY'S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM, LOSS, OR DAMAGE ARISING OUT OF OR RELATING TO YOUR PURCHASE OR USE OF OUR PRODUCTS SHALL BE LIMITED TO THE TOTAL AMOUNT YOU HAVE PAID TO US FOR THE SPECIFIC PRODUCT(S) GIVING RISE TO THE CLAIM. SAUCESAVVY, ITS DIRECTORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO, ALLERGIC REACTIONS, PERSONAL INJURY, OR FINANCIAL LOSS, ARISING FROM YOUR USE OF OUR PLATFORM OR CONSUMPTION OF OUR PRODUCTS.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. In the event of any dispute, claim, or controversy arising from or relating to these Terms or our Service, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

12. Policy Updates

We reserve the right to update, amend, or modify these Terms of Service at any time. Any revised Terms will be posted on this page of our Platform, and the "Last Updated" date at the top will be amended accordingly. Any order will be subject to the Terms in effect at the time the order is placed. Your continued use of our Platform after any such changes are posted constitutes your acceptance of the new Terms for future use and purchases.
